Please read these Terms and Conditions carefully. Your participation in Liquid Home’s “Its Giving Christmas” Promotion constitutes consent to comply with and to be bound by these Terms and Conditions.

1. DEFINITIONS

   The following definitions are used in these Terms and Conditions:

   1. “Customer” For the purposes of this Promotion means any natural person registered for Liquid Home’s FibroniX services excluding FibroniX customers that access the services using the Multiprotocol Label Switching (“MPLS”) technology;
   2. “FibroniX” means FTTX (Fibre To The Home/Enterprise) internet connection using optic fibre technology;
   3. “Promotion” means the Liquid Home “Its Giving Christmas” FibroniX  Promotion;
   4. “Promotion Period” means midnight on 1 November 2023 to 2359 hours on 28 January 2024;
   5. “Promotion Speed” means the increased maximum rate of transmitting data over an internet connection that a Customer may experience under the ideal conditions, after the Qualifying Product has been upgraded by Liquid Home, subject to these Terms and Conditions;
   6. “Liquid Home” means Data Control & Systems (1996) (Private) Limited and its respective successors and assigns;
   7. “Qualifying Products” means the products listed in Clause 3 below and available on here.
2. DURATION OF PROMOTION

   This Promotion shall run from 1 November 2023 to 28 January 2024.

4. ELIGIBILITY CRITERIA

   Any Customer that purchases any of the Qualifying Products listed in Clause 3 above, during the Promotion Period, will automatically be able to enjoy the product purchased at the Promotion Speed provided, during the Promotion Period, subject to these Terms and Conditions

5. GENERAL TERMS AND CONDITIONS
   1. This Promotion shall run from midnight on the 1st of November 2023 to 2359 on the 31st of January 2024. Customers will only be able to enjoy the Promotion Speeds for the duration of the Promotion i.e the Promotional Period only.
   2. This Promotion is only open to FibroniX Customers who purchase the Qualifying Products listed in Clause 3 and available on this page here.
   3. Customers accessing Liquid Home services using FibroniX On the Go will not be able to enjoy the applicable Promotion Speeds at any Liquid Home/Sasai WiFi Hotspots available countrywide.
   4. Upon receiving payment for any of the Qualifying Products during the Promotional Period, Liquid Home will automatically upgrade the speeds of the Qualifying Product to enable you to experience the Promotion Speeds provided in Clause 3 as provided.
   5. Customers on corporate packages are also excluded from this Promotion. Any corporate package that is migrated to a Qualifying Package, if permitted, will not be upgraded for the Customer to experience the applicable Promotional Speed.
   6. The Promotion Speeds provided in Clause 3, are the maximum speeds that a Customer may enjoy under the ideal conditions. The actual speeds experienced may vary due to several factors, including but not limited to the quality of your device, the customer premises equipment (“CPE”) used by the Customer, network congestion, distance from the CPE, and other environmental factors.
   7. All Qualifying Products are subject to Liquid Home’s Fair Usage Policy available on https://zw.liquidhome.tech/legal/fair-usage-policy. Customers are also advised to view Liquid Home’s Package Health tips available on https://bit.ly/3QI8igI.
   8. This Promotion is open to all Liquid Home FibroniX Customers who are eligible in terms of Clause 4 above and excluding FibroniX Customers on the Small to Medium Enterprises and Corporate packages.
   9. Any decision or determination on any other matter in relation to this Promotion by Liquid Home will be final, conclusive, and binding, and no correspondence in relation thereto will be permitted.
   10. Liquid Home reserves the right to vary, delete or add to any of these terms and conditions at any time, at its absolute discretion, without prior notice and without incurring any liability to the Customer or any third parties.
   11. In the event of any inconsistency between these Terms and Conditions and any brochure, marketing material or information provided by Liquid Home on any platform in relation to this Promotion, these terms and conditions shall prevail.
   12. Liquid Home will not be liable for any claims, costs, injuries, losses, or damages of any kind whatsoever arising out of or in connection with this Promotion (including, without limitation, claims, costs, injuries, losses, or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy or defamation).
   13. Liquid Home reserves the right to upgrade the prices of the Qualifying Products during the duration of this Promotion, as may be deemed necessary in its discretion, subject to the terms and conditions on which the Qualifying Products are being provided.
   14. Liquid Home shall be entitled to prohibit or terminate any Customers’ participation in the Promotion, if such Customer does not meet the eligibility criteria detailed herein or has breached any of these terms and conditions and/or if the Customer is involved in any fraudulent activity or suspected fraudulent activity relating to the Customers’ participation in the Promotion.
   15. These terms and conditions shall be binding on the Parties hereto and their respective successors and assigns. The Customer shall not be entitled to assign or otherwise transfer the benefit or burden of all or any part of these terms and conditions. Liquid Home may assign or its rights and obligations under these terms and conditions to an affiliate, subsidiary, or parent company without the prior approval of the Customer.
   16. Liquid Home shall not be responsible for any breach, failure or delay in performing any obligation if such failure or delay is due to an act of God, epidemic, war, fire, strike, accident, governmental acts or requirements, or other causes, either similar or dissimilar to the foregoing, beyond the Liquid Home’s control.
   17. Liquid Home also reserves the right to cancel, alter or discontinue, this Promotion at any time during the Promotion Period for any reason whatsoever.
   18. These terms and conditions shall be governed by the laws of Zimbabwe.
   19. By signing up for a Liquid Home FibroniX account and proceeding to purchase or subscribe for any Liquid Home FibroniX package, you automatically enter the “Its Giving Christmas” Promotion and you agree to be bound by these Terms and Conditions. Failure to comply with these Terms and Conditions will result in you being disqualified from participating in the Promotion.
   20. Notwithstanding anything in these terms and conditions, any products or services (including any Qualifying Product) purchased from Liquid Home during the Promotion Period shall be subject to the terms and conditions of services available on https://zw.liquidhome.tech/legal/terms-and-conditions-of-service.
