Terms and Conditions for Liquid Home Speed Plus USD Bundles Promotion.

The following Terms and Conditions apply to the LIT USD Bundles Promotion.

  1. DEFINITIONS

    The following definitions are used in these Terms and Conditions:

    1. “Activation Date” means the date the Customer elects to start using the Services offered in terms of this Promotion;
    2. “Commencement Date” means the date on which the Customer accepts these Terms and Conditions by registering to participate in this Promotion and paying for the Services;
    3. “Customer” means a person who has registered for the Promotion and has purchased any of the LIT USD Bundles Promotion;
    4. “Activation Date” means the date the Customer elects to start using the Services offered in terms of this Promotion;
    5. “FibroniX” means FTTX (Fibre To The Home/Enterprise) internet connection using optic fibre technology;
    6. “Services” means LIT USD Bundles Promotion provided by Liquid Home packages available on https://zw.liquidhome.tech/lit-usd-bonus-bundles-promotion;
    7. “Liquid Home” means Data Control & Systems (1996) (Private) Limited trading as Liquid Intelligent Technologies;
    8. “LIT USD Bundles Promotion.” means promotional bundles or Liquid Home packages available on https://zw.liquidhome.tech/lit-usd-bonus-bundles-promotion;
    9. “LIT Promotion ID” means an account created for the Customer for the purposes of this Promotion only, to purchase the Services. Liquid Home will provide a LIT Promotion ID to all Customers that register for the Promotion.
    10. “Promotion” means the LIT USD Bundles Promotion valid for the period provided in paragraph 4 below;
    11. “PAYG” means pay as you go;
    12. “Terms and Conditions” or “Agreement” means these Terms and Conditions LIT USD Bundles Promotion as read with the Liquid Home General Terms and Conditions of Service available on the Liquid Home’s website https://zw.liquidhome.tech/;
    13. “USD” means United States Dollars.
    14. “WibroniX” means the internet connection services provided by Liquid Home using wireless technology called Long Term Evolution (LTE);
  2. THE AGREEMENT
    1. By registering to participate in this Promotion, the Customer agrees to purchase LIT USD Bundles Promotion Plus USD Bundles and to be bound by these Terms and Conditions, the Liquid Home General Terms and Conditions available on https://zw.liquidhome.tech and the Liquid Home Fair Usage Policy available on https://zw.liquidhome.tech/legal/fair-usage-policy, herein incorporated by reference.
    2. These Terms and Conditions shall only apply for the duration of this Promotion.
    3. The Services offered in terms of this Promotion can only be purchased in United States dollars, at any Liquid Home Shop or online at https://zw.liquidhome.tech/lit-usd-bonus-bundles-promotion.
    4. A Customer must read and fully understand these Terms and Conditions before registering to participate in this Promotion.
  3. DURATION OF PROMOTION
    1. This Promotion will run for a period commencing at 00:00 hours on 27 December 2022 to 23:59 hours on 30 June 2024.
    2. Notwithstanding the period provided in paragraph 3.1 above, Liquid Home may in its sole and absolute discretion, amend the duration of the Promotion to a shorter or longer period, or withdraw any of the Services offered in terms of this Promotion entirely, with notice to you. Customers must visit zw.liquidhome.tech for regular notices, updates and/or details about any changes to Services.
  4. ELIGIBILITY CRITERIA

    Any new and/or existing Customers who register for the Promotion and purchase any of the Services shall be eligible to participate in the promotion.

  5. HOW IT WORKS
    1. All eligible Customers who wish to participate in this Promotion are required to;
      1. For existing Customers currently registered for any of Liquid Home’s WibroniX or FibroniX’ s Services;

        Step 1 - Read and understand these Terms and Conditions before going through the Services offered in terms of this Promotion available on https://zw.liquidhome.tech/lit-usd-bonus-bundles-promotion.

        Step 2 - Send an email to zw-usd-billing@liquid.tech expressing your interest to register for the Promotion and the desired start date. Alternatively, Customers may register via our website, zw.liquidhome.tech.

        Step 3 - Thereafter, Liquid Home will create a new LIT Promotion ID for the Customer (for the purposes of this Promotion only) and a confirmation email with the details of the LIT Promotion ID account will be sent to the Customer.

        Step 4 - After receiving a message confirming registration for the Promotion, the Customer may log in to the myLiquid Home application using their current LIT Home ID or LIT Promotion ID and select the new service and immediately purchase their preferred LIT USD Bundles Promotion.

        Please note: Once a Customer has opted in and registered for the Promotion, they will no longer be able to purchase any of the other services that are not offered in terms of this Promotion.

        In-store assistance will also be available for payments, or registration for this Promotion.

      2. Existing Customers already paying for Liquid Home’s WibroniX or FibroniX’s Services in USD, no additional action is required from the Customer, the LIT USD Bundles Promotion Plus USD Bundle will automatically appear on the list of Services the Customer can purchase when they log into their myLiquid account.
      3. New Customers must first register for Liquid Home’s WibroniX or FibroniX’s Services. Upon completion of registration, the Customer will be required to follow the steps listed in paragraph 5.1.1 above.
    2. Each of the Services allows the Customer to enjoy additional benefits i.e data to access YouTube, Facebook, WhatsApp & Netflix. The additional data benefits are capped at the value of the main data purchase for any of the Services. For example, if a Customer purchases a FibroniX SpeeD Plus Netflix Bundles 100GB, the Customer will enjoy 100GB (main data) and an additional 100GB of Netflix data. However, the Customer will only be able to enjoy the additional 100 GB of Netflix data if they have not exhausted the main data balance purchased.
  6. VALIDITY
    1. All Services purchased in terms of this Promotion are valid for 15 (fifteen) days + an additional 15 (fifteen) days rollover, cumulatively amounting to (30) thirty days.
    2. Any unused data for any of the Services offered in terms of this Promotion will only be rolled over after the period in paragraph 6.1 has lapsed, only if the Customer purchases a LIT USD Bundles Promotion,
    3. Any payments for the Services offered in terms of this Promotion will not be automatically credited to the Customers myLiquid account. The Customer is required to convert the funds in the myLiquid account to a data bundle of their choice via the myLiquid Home application.
  7. OPTING OUT
    1. Customers that have registered for the Promotion that wish to opt out before the expiry date of the Promotion will be required to give Liquid Home at least (30) thirty days' written notice, notifying Liquid Home of their intention to revert to Liquid Home’s services that are not offered in terms of this Promotion.
    2. Customers may deliver a written notice to opt out in terms of paragraph 7.1 at any of Liquid Home’s offices in Zimbabwe or by sending an email to zw-usd-billing@liquid.tech.
  8. GENERAL
    1. All queries pertaining to this Promotion should be directed to Liquid Home Billing Team by calling toll-free number 08677123123 or sending an email to zw-usd-billing@liquid.tech. Liquid Home’s usual support channels will remain available to assist.
    2. Any decision or determination on any matter in relation to this Promotion by Liquid Home will be final, conclusive, and binding, and no correspondence in relation thereto will be permitted.
    3. Liquid Home reserves the right to vary, delete or add to any of these terms and conditions at any time at its absolute discretion, without prior notice and without incurring any liability to the Customer or any third parties.
    4. In the event of any inconsistency between these Terms and Conditions and any brochure, marketing material or information provided by Liquid Home on any platform in relation to this Promotion, these Terms and Conditions shall prevail.
    5. Liquid Home will not be liable for any claims, costs, injuries, losses, or damages of any kind whatsoever arising out of or in connection with this Promotion (including, without limitation, claims, costs, injuries, losses, or damages related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy or defamation).
    6. Liquid Home reserves the right to increase the prices of the Services during the duration of this Promotion, as may be deemed necessary in its discretion, subject to these terms and conditions on which the Services are being provided.
    7. Liquid Home shall be entitled to prohibit or terminate any Customers’ participation in the Promotion if such Customer does not meet the criteria detailed herein or has breached any of these terms and conditions and/or if the Customer is involved in any fraudulent activity or suspected fraudulent activity relating to the Customers’ participation in the Promotion.
    8. All Prices for the Services offered in terms of this Promotion include Value Added Tax and any other taxes applicable to all Customers.
    9. Any purchases for the Services will not be irreversible and benefits for any of the Services are subject to change without notice. Any such change will not affect any purchases made before the changes were effected.
    10. This product is only available to customers around Zimbabwe and accessible through Liquid Zimbabwe’s Network.
    11. These terms and conditions shall be binding on the Parties hereto and their respective successors and assigns. The Customer shall not be entitled to assign or otherwise transfer the benefit or burden of all or any part of these terms and conditions. Liquid Home may assign or its rights and obligations under these terms and conditions to an affiliate, subsidiary, or parent company without the prior approval of the Customer.
    12. Liquid Home shall not be responsible for any breach, failure or delay in performing any obligation if such failure or delay is due to an act of God, epidemic, war, fire, strike, accident, governmental acts or requirements, or other causes, either similar or dissimilar to the foregoing, beyond the Party’s control.
    13. The Customer agrees to indemnify and hold Liquid Home, its employees, agents, contractors or subcontractors, directors and affiliates, harmless from and against all claims and all liabilities, costs, proceedings, damages (direct, indirect or consequential) and expenses (including legal and other professional fees and expenses) awarded against, or incurred or paid by, the Customer, as a result, anything in connection to or arising from this Promotion.
    14. These terms and conditions shall be governed by the laws of Zimbabwe. Terms other than those defined within these Terms and Conditions, the Liquid Home General Terms and Conditions or the Liquid Home Service Order form signed by the Customer shall be given their plain English meaning.
